1. Who we are and acceptance of these terms

This website is operated by Car4Less (“Car4Less”, “we”, “us”), a South African business. By accessing or using this website, submitting an enquiry, or making use of any Car4Less service, you agree to be bound by these terms and conditions. If you do not agree with any part of them, please do not use the website or our services.

We may amend these terms from time to time. The version published on this page at the time of your use is the version that applies. Material changes will be reflected in the “last updated” date above.

2. Pricing and estimates

All prices quoted on this website are estimate prices only, and Car4Less will not be held responsible or bound to deliver at quoted estimate prices. Vehicle prices, specifications, imagery, instalment illustrations and availability are indicative, are drawn from third-party and manufacturer sources, change frequently, and may contain errors. Errors and omissions excepted (E&OE).

No content on this website constitutes a binding offer capable of acceptance. A binding price arises only when confirmed to you in writing by a Car4Less consultant for a specific vehicle, on a specific date, subject to stock availability.

Prices shown on this website are Car4Less prices: discounted prices below the manufacturers' recommended retail prices (which are shown struck through for reference), as captured at the time of publication. All prices shown are estimates only and may since have changed (E&OE). The Programme Car price, being the Car4Less price plus the cost of the Payment Saver Plan as determined by Car4Less for each transaction, is not shown on this website; it is set out in a separate offer to purchase (OTP) for a specific vehicle, which Car4Less sends to the buyer for approval. Any price, whether a Car4Less price or a Programme Car price, binds Car4Less only once confirmed in writing, and every vehicle, at either price, is financed only through the Car4Less finance application — cash purchases are not permitted and private finance is not accepted.

3. The Car4Less model

Car4Less is an independent vehicle-buying channel. We arrange the transaction; vehicles are supplied, registered and delivered brand new through the manufacturers' authorised franchise dealer networks, with the full manufacturer warranty and any standard service or maintenance plan intact. Car4Less is not the manufacturer or the delivering dealer, and does not itself provide warranties on vehicles — warranty and plan obligations rest with the manufacturer and its network on their standard terms.

The Programme Car.Every vehicle on this website is shown at its Car4Less price. Car4Less's main focus is the Programme Car: a brand-new vehicle at the Car4Less price plus the Payment Saver Plan, set out in a separate offer to purchase that Car4Less sends to the buyer for approval, and financed through the Car4Less finance application. Car4Less does not sell vehicles for cash, and cash purchases are not permitted. Private, third-party or buyer-arranged finance is not accepted. Every purchase through Car4Less is financed by way of a finance application submitted exclusively through the Car4Less finance application to the major banks (currently WesBank, Absa, MFC and Standard Bank). Car4Less may, in its sole discretion, decline to proceed with any transaction that does not follow this route.

Where a buyer participates in the Payment Saver Plan, there is a cost associated with the plan. That cost differs from deal to deal, is determined by Car4Less for each transaction, and is incorporated into the vehicle's financeable retail price. The buyer's monthly instalment, which includes that cost, continues to be paid by debit order to the financing bank in the usual way. The Payment Saver Plan does not alter, replace or form part of the buyer's finance agreement with the bank.

4. The Payment Saver Plan (Post & Share)

The Payment Saver Plan is a non-insurance product. It is not an insurance policy, insurance product or insurance benefit of any kind for the participant, and nothing in the plan constitutes a financial product or investment for the participant. You do not purchase, hold or pay a premium for any insurance policy. Taking part in the plan's qualifying activities is voluntary, but only a participant who meets the qualifying requirements in full may be considered for any payment under the plan.

Subject to these terms, the written Payment Saver Plan agreement referred to in clause 7 and the final determination of Car4Less in its sole discretion, a qualifying participant may receive an ex gratia payment of up to R3 000 per month, resulting in an effective reduction of up to R3 000 in the participant's monthly vehicle instalment. “Ex gratia” means a voluntary payment made by Car4Less, and not a payment arising from any contractual or legal obligation. Car4Less alone decides whether to make, or not to make, any such payment, and its determination is final. The participant has no recourse, right of action or claim against Car4Less in respect of any payment that is not made, or that is made in a lesser amount. Any payment that Car4Less elects to make is paid into the participant's Mastercard rewards card, issued and administered by a regulated financial services provider, and does not alter the participant's instalment obligations to the financing bank.

To be considered, participants must meet all of the qualifying requirements in full, namely: creating, posting and sharing approved Car4Less content through authorised channels, being three approved posts per day on each of Facebook, Instagram, TikTok, YouTube and LinkedIn, seven days a week, of the prescribed quality and within the prescribed periods; joining and remaining in the prescribed groups; and meeting the Shop & Save requirements described in clause 5 — in each case as set out in the plan rules provided to participants and as amended from time to time.

Approval before publication. All content must be submitted to Car4Less for approval before it is published, in the manner Car4Less prescribes from time to time (currently by email). Only content that has been approved and released by Car4Less, and that the participant has actually published, counts towards the qualifying requirements. Car4Less approves content before release so that nothing defamatory, incorrect or misleading is published under the Car4Less name. The publication of unapproved content under or in connection with the Car4Less name constitutes a breach of these terms and of the Payment Saver Plan agreement, and non-qualifying or unapproved activity does not count towards the requirements.

Any illustration on this website (for example “R6 500 − R3 000 = R3 500 effective instalment”) is an example only and is not a promise of a particular outcome for any individual. No illustration or description of the value of the Payment Saver Plan, whether on this website or elsewhere, constitutes a statement of any total amount receivable or a guaranteed return.

5. Shop & Save

Shop & Save is a qualifying requirement of the Payment Saver Plan and not a separate programme or a separate benefit. It is the verified-shopping part of the plan's requirements: participants are required to complete prescribed, verified shopping at participating partner retailers (currently Checkers, Pick n Pay, Dis-Chem and Shoprite). Meeting the Shop & Save requirements does not give rise to any payment or discount in addition to the Payment Saver Plan benefit described in clause 4. Participating retailers, qualifying purchases and verification methods are determined by Car4Less and its partners and may change without notice.

6. Cash-Back and Loyalty Rewards — eligibility

Only qualifying parties who have fully complied with and fulfilled all applicable obligations, requirements and participation conditions, stipulated or not, in any terms and conditions shall be eligible to be considered for any Cash-Back or Loyalty Reward. The qualifying requirements are all-or-nothing: the prescribed participation must be completed in full.

A participant is not required to produce, demonstrate or be credited with the sale of a motor vehicle resulting from their posting, sharing, shopping or other qualifying participation in order to be considered for a Cash-Back or Loyalty Reward. However, meeting the qualifying requirements shall not, in itself, create or establish any right, entitlement or claim to any Cash-Back or Loyalty Reward. Any Cash-Back or Loyalty Reward is an ex gratia payment made at the sole and final determination of Car4Less.

Furthermore, the granting, availability, approval, rejection, non-exercise, cancellation or non-utilisation of any loyalty rewards, or of any performance guarantee policy, contingency policy or other facility held or not held by or through Car4Less, shall not, in itself, create, confer, constitute or establish any entitlement whatsoever to a Cash-Back, Loyalty Reward, payment, benefit or other consideration under these terms and conditions.

Car4Less's performance guarantee policy. Car4Less holds a performance guarantee policy, being a contingency policy, with its own underwriters. Car4Less pays a single premium for the overall risk under that policy, and not a premium per vehicle sold. The policy is held by, and for the sole benefit of, Car4Less as a financial backstop supporting Car4Less's ability to fund Cash-Backs and Loyalty Rewards, and it is exercised only if Car4Less, in its sole discretion, chooses to exercise it. No participant, buyer or other party pays any premium or other amount towards that policy, is a party to it, or acquires any right, title, interest, benefit or claim, whether direct or indirect, under or against it. A participant's potential benefit rests solely on the Payment Saver Plan terms and on Car4Less's determination, and not on that policy.

Guaranteed funding provision.Any reference to “guaranteed”, “guaranteed funding”, “the guaranteed R3 000 funding provision” or “the guarantee” in any Car4Less communication, whether on this website, in marketing, on social media or elsewhere, refers solely to the specific funding provision defined by Car4Less's performance guarantee policy (contingency policy) described above, according to the terms of that policy. Such references do not constitute, and shall not be construed as, an unconditional guarantee, warranty or assurance that any participant will receive any Cash-Back, Loyalty Reward or other payment, or any amount of R3 000 or otherwise, in any month. Participation remains conditional on the qualifying requirements being fully satisfied, and any Cash-Back or Loyalty Reward remains discretionary and an ex gratia payment subject to the final determination of Car4Less. The Payment Saver Plan is most definitely not a policy, and no participant pays any premium towards, is a party to, or has any claim under Car4Less's performance guarantee policy.

Final assessment and ex gratia payments.Car4Less performs the final assessment of whether the applicable qualifying requirements have been satisfied and of whether any Cash-Back or Loyalty Reward will be paid, and in what amount, and Car4Less's determination in this regard is final. Every such payment is an ex gratia payment — made voluntarily and as a gesture of goodwill, without any admission of legal liability or of any entitlement on the part of the recipient, and without creating any precedent, expectation or entitlement in respect of any other party or any future payment.

Other participants. Payments to business consultants, call-centre agents and private individuals (including influencers) who create, post or share approved Car4Less content are likewise ex gratia payments, made according to the parameters prescribed for each such party, subject to the applicable terms and conditions and the final determination of Car4Less, and are not contingent on a vehicle sale being attributed to that party. This clause does not apply to commission payable to a Business Agency under a Business Agency Agreement, which is governed by clause 12 and that agreement.

7. The Payment Saver Plan agreement and content conduct

Every new-car buyer who participates in the Payment Saver Plan enters into a written Payment Saver Plan agreement with Car4Less, which sets out the qualifying requirements, the potential benefit and the conditions of participation in full. That agreement is to be read together with these terms and conditions.

Participants may not create, post, share or publish, on any platform or in any medium, content about Car4Less, its owners, employees, agents, partners, products or services that is defamatory, deliberately misleading or maliciously negative. A deliberate breach of this requirement disqualifies the participant from any further Payment Saver Plan benefits for the remainder of their vehicle agreement. Genuine, honest and positive content about the participant's own experience with Car4Less is encouraged.

8. No guarantee of income, earnings or financial benefit

Nothing contained in these terms and conditions, or in any associated promotional, marketing, advertising, social media or other communication relating to Car4Less, shall constitute, create or be construed as a guarantee, warranty, representation or assurance, whether express or implied, that any party will earn, receive or generate any income, earnings, remuneration, Cash-Back, Loyalty Reward, commission, payment, financial return or other monetary benefit whatsoever.

No income, earnings, financial return, Cash-Back, Loyalty Reward or other monetary benefit is guaranteed, promised or assured to any party. Any such benefit is conditional upon the applicable qualifying requirements being fully satisfied and remains, in every case, subject to the final determination of Car4Less in its sole discretion. Each party acknowledges and accepts that participation, and the full satisfaction of the qualifying requirements, does not, in itself, guarantee or create any entitlement to or expectation of income, earnings, financial return, Cash-Back, Loyalty Reward or other monetary benefit. Any reference to Car4Less's registered slogan is a description of the Car4Less buying model and does not guarantee any Cash-Back or Loyalty Reward to any party. References to a guaranteed funding provision are to be read in accordance with the “Guaranteed funding provision” paragraph of clause 6: they describe the funding provision under Car4Less's performance guarantee policy only, and nothing in this clause 8 or in clause 6 is to be read as contradicting the other.

9. Superseding, replacing and prevailing terms and conditions

These terms and conditions, as published on the official Car4Less website at car4less.co.za, constitute the final and controlling wording in respect of Cash-Backs, Loyalty Rewards and any related benefit. They expressly supersede, replace and take precedence over any and all previous versions, drafts, wording, representations, statements, terms, conditions, provisions, interpretations or communications relating to Cash-Backs, Loyalty Rewards or any related benefit appearing on, through or in connection with any other social media platform, publication, document, advertisement, promotional material, marketing communication, post, message or other medium relating to Car4Less.

In the event of any inconsistency, conflict, discrepancy or difference between these terms and conditions published on car4less.co.za and any previous or alternative wording, statement, representation, advertisement, post, publication, document or other communication appearing elsewhere, these terms and conditions shall prevail and shall constitute the sole controlling and applicable terms governing eligibility for, and entitlement to, any Cash-Back or Loyalty Reward.

For the avoidance of doubt, this provision is intended to operate as a complete supersession and replacement of all previous or conflicting wording relating to Cash-Backs, Loyalty Rewards and related benefits. No previous version, alternative wording, draft, representation, statement, advertisement, publication, promotional material, marketing communication, social media post, document or other communication shall have any preference, priority, force or effect to the extent that it is inconsistent with, conflicts with, or differs from these terms and conditions, and none shall amend, vary, override or supersede these terms and conditions, or create any entitlement contrary to them, unless such amendment or variation is expressly incorporated into the terms and conditions published on car4less.co.za by Car4Less. Accordingly, these terms and conditions shall be regarded as the final, superseding and prevailing wording, and no other version shall take preference, precedence or priority over them.

10. Vehicle finance

Vehicle finance is provided by third-party registered credit providers (banks), not by Car4Less. Any finance agreement is concluded directly between you and the bank on the bank's standard terms, subject to the bank's credit and affordability assessment under the National Credit Act 34 of 2005. Car4Less is not a registered credit provider and does not guarantee finance approval, any particular interest rate, or any particular instalment. Calculator results on this website are planning estimates only and exclude bank initiation and service fees.

Finance applications for vehicles supplied through Car4Less are accepted exclusively through the Car4Less finance application, from which they are submitted to the major banks. Car4Less does not accept cash purchases or private finance.

11. Delivery

Delivery is arranged once finance has been approved and stock is available, through the authorised national franchise dealer network. Delivery timeframes depend on manufacturer stock and logistics and are estimates only. Risk in a vehicle passes on delivery in accordance with the sale documentation. Any deposit or trade-in arrangement will be recorded in writing before you are bound.

12. The Business Agency (franchise) opportunity

Information on this website about the Car4Less Business Agency — including capital packages and income tables — is a summary of the official Business Agency Proposal and is provided for information only. Income figures are illustrative scenarios, not a guarantee, forecast or promise of income.Actual results depend on the agency's activity and market conditions. No business agency relationship arises until a Business Agency Agreement is concluded and the applicable capital payment is made. Prospective owners should obtain independent legal and financial advice before committing.

13. Enquiries and submissions

Forms on this website hand off to WhatsApp or email; by submitting an enquiry you consent to Car4Less contacting you about it on the details you provide. You warrant that information you submit is accurate and that you are entitled to provide it. Communications transmitted over WhatsApp or email are subject to those platforms' own terms and security.

14. Intellectual property

The Car4Less name, logo, slogan, website content, page designs, diagrams and documents are the property of Car4Less or its licensors and are protected by law, including the government- gazetted provisional patent covering the Car4Less model. Vehicle manufacturer names, logos and model names are the trade marks of their respective owners and are used for identification only — their appearance does not imply endorsement of Car4Less. You may not reproduce, scrape, frame or commercially exploit content from this website without our prior written consent.

15. Website use and availability

You may use this website only for lawful purposes. You may not attempt to gain unauthorised access, interfere with its operation, introduce malicious code, or use automated tools to extract data at scale. We may suspend, change or withdraw any part of the website at any time without notice, and we do not warrant that the website will be uninterrupted or error-free.

16. Third-party content and links

The website links to third-party platforms and articles (for example WhatsApp, Medium, bank and manufacturer sites). We do not control and are not responsible for third-party content, terms or privacy practices. A link does not imply endorsement.

17. Disclaimers

The website and its content are provided “as is” for general information. Nothing on this website constitutes financial, legal, tax or insurance advice, or advice as contemplated in the Financial Advisory and Intermediary Services Act. Reviews, comparisons, guides and blog articles reflect editorial opinion and publicly reported information at the time of writing and may become outdated.

18. Limitation of liability

To the maximum extent permitted by law — and without limiting any right you may have under the Consumer Protection Act 68 of 2008 — Car4Less, its owners, employees and agents will not be liable for any indirect, incidental, special or consequential loss, loss of profit, loss of data or loss of opportunity arising from your use of this website or reliance on its content. Where liability cannot be excluded, it is limited to the maximum extent the law allows. Nothing in these terms excludes liability for gross negligence or wilful misconduct to the extent such exclusion would be unenforceable.

19. Indemnity

You indemnify Car4Less against claims, losses and costs arising from your breach of these terms, your unlawful use of the website, or inaccurate information you supply to us.

20. Privacy

Personal information is processed in accordance with our Privacy Policy, which forms part of these terms.

21. General

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction. If any provision is held unenforceable, the remainder continues in force. No failure to enforce a provision is a waiver of it. These terms, together with any written documents concluded with you, are the whole agreement regarding the website.
