1. Who we are and acceptance of these terms

This website is operated by Car4Less (“Car4Less”, “we”, “us”), a South African business. By accessing or using this website, submitting an enquiry, or making use of any Car4Less service, you agree to be bound by these terms and conditions. If you do not agree with any part of them, please do not use the website or our services.

We may amend these terms from time to time. The version published on this page at the time of your use is the version that applies. Material changes will be reflected in the “last updated” date above.

2. Pricing and estimates

All prices quoted on this website are estimate prices only, and Car4Less will not be held responsible or bound to deliver at quoted estimate prices. Vehicle prices, specifications, imagery, instalment illustrations and availability are indicative, are drawn from third-party and manufacturer sources, change frequently, and may contain errors. Errors and omissions excepted (E&OE).

No content on this website constitutes a binding offer capable of acceptance. A binding price arises only when confirmed to you in writing by a Car4Less consultant for a specific vehicle, on a specific date, subject to stock availability. Manufacturer retail prices shown for comparison are recommended prices at the time of capture and may since have changed.

3. The Car4Less model

Car4Less is an independent vehicle-buying channel. We arrange the transaction; vehicles are supplied, registered and delivered brand new through the manufacturers' authorised franchise dealer networks, with the full manufacturer warranty and any standard service or maintenance plan intact. Car4Less is not the manufacturer or the delivering dealer, and does not itself provide warranties on vehicles — warranty and plan obligations rest with the manufacturer and its network on their standard terms.

4. The Payment Saver Plan (Post & Share)

The Payment Saver Plan is a rewards programme under which qualifying new-car buyers may receive a cashback value proposition of up to R3 000 per month. Participation is voluntary — you may buy a vehicle through Car4Less without participating.

Cashback is conditional on qualification: participants must complete the prescribed posting-and-sharing activities, in the prescribed volumes and quality, within the prescribed periods, as set out in the plan rules provided to participants and as amended from time to time. Activities are subject to moderation, and non-qualifying activity does not earn the reward. Any illustration on this website (for example “R6 500 − R3 000 = R3 500 effective instalment”) is an example only and is not a promise of a particular outcome for any individual.

The reward structure is backed by a performance-guarantee arrangement between Car4Less and its underwriting institutions. You do not purchase, hold or pay a premium for any insurance policy, and nothing in the plan constitutes an insurance product, financial product or investment for the participant.

5. Shop & Save

Shop & Save is a separate loyalty programme offering reward discounts of up to R3 000 per month in value at participating national retailers. It operates independently of the Payment Saver Plan; the two programmes are never combined into a single amount. Participating retailers, qualifying products and discount levels are determined by the loyalty partners and may change without notice.

6. Cash-Back and Loyalty Rewards — eligibility

Only qualifying parties who have fully complied with and fulfilled all applicable obligations, requirements and participation conditions, stipulated or not, in any terms and conditions shall be eligible to receive any Cash-Back or Loyalty Reward.

Any Cash-Back or Loyalty Reward shall only become due and payable where the qualifying party's participation directly and demonstrably results in a successful sale and delivery of a new motor vehicle to an independent third-party purchaser. Participation, posting, sharing, referring, promoting or undertaking any other qualifying activity, without a resulting successful sale and delivery of a new motor vehicle to a third-party purchaser, shall not, in itself, create or establish any right, entitlement or claim to any Cash-Back or Loyalty Reward. Accordingly, where no qualifying vehicle sale and delivery occurs, no Cash-Back or Loyalty Reward shall accrue, become payable or be claimable by any party.

Furthermore, the granting, availability, approval, rejection, non-exercise, cancellation or non-utilisation of any loyalty rewards, or insurance policy, insurance benefit, insurance-related offering or other insurance facility provided or not, by or through Car4Less, shall not, in itself, create, confer, constitute or establish any entitlement whatsoever to a Cash-Back, Loyalty Reward, payment, benefit or other consideration under these terms and conditions.

For the avoidance of doubt, no party shall acquire any vested right, contractual entitlement or claim to any Cash-Back or Loyalty Reward unless and until all applicable qualifying conditions have been satisfied, including the successful completion and delivery of the relevant new motor vehicle sale.

Sole right to the guarantee facility. Any performance-guarantee arrangement, insurance policy, insurance benefit or related facility established by or through Car4Less in connection with any Cash-Back or Loyalty Reward is held by, and for the sole benefit of, Car4Less. Car4Less alone has the sole and exclusive right to access, invoke, exercise or claim under any such facility. No participant, buyer or other party pays any premium in respect of any such facility, and no participant, buyer or other party acquires any right, title, interest, benefit or claim, whether direct or indirect, under or against any such facility.

Final assessment and ex-gratia payments.Car4Less performs the final assessment of whether the applicable qualifying conditions have been satisfied and of whether any Cash-Back or Loyalty Reward is payable, and Car4Less's determination in this regard is final. Any payment made in circumstances where the applicable qualifying conditions have not been strictly satisfied shall be an ex-gratia payment — made voluntarily and as a gesture of goodwill, without any admission of legal liability or of any entitlement on the part of the recipient, and without creating any precedent, expectation or entitlement in respect of any other party or any future payment.

7. No guarantee of income, earnings or financial benefit

Nothing contained in these terms and conditions, or in any associated promotional, marketing, advertising, social media or other communication relating to Car4Less, shall constitute, create or be construed as a guarantee, warranty, representation or assurance, whether express or implied, that any party will earn, receive or generate any income, earnings, remuneration, Cash-Back, Loyalty Reward, commission, payment, financial return or other monetary benefit whatsoever.

No income, earnings, financial return, Cash-Back, Loyalty Reward or other monetary benefit is guaranteed, promised or assured to any party, and any such benefit is strictly conditional upon the applicable qualifying requirements being fully satisfied and the successful sale and delivery of a qualifying new motor vehicle occurring as a direct and demonstrable result of the relevant qualifying participation. Each party acknowledges and accepts that participation does not, in itself, guarantee or create any expectation of income, earnings, financial return, Cash-Back, Loyalty Reward or other monetary benefit.

8. Superseding, replacing and prevailing terms and conditions

These terms and conditions, as published on the official Car4Less website at car4less.co.za, constitute the final and controlling wording in respect of Cash-Backs, Loyalty Rewards and any related benefit. They expressly supersede, replace and take precedence over any and all previous versions, drafts, wording, representations, statements, terms, conditions, provisions, interpretations or communications relating to Cash-Backs, Loyalty Rewards or any related benefit appearing on, through or in connection with any other social media platform, publication, document, advertisement, promotional material, marketing communication, post, message or other medium relating to Car4Less.

In the event of any inconsistency, conflict, discrepancy or difference between these terms and conditions published on car4less.co.za and any previous or alternative wording, statement, representation, advertisement, post, publication, document or other communication appearing elsewhere, these terms and conditions shall prevail and shall constitute the sole controlling and applicable terms governing eligibility for, and entitlement to, any Cash-Back or Loyalty Reward.

For the avoidance of doubt, this provision is intended to operate as a complete supersession and replacement of all previous or conflicting wording relating to Cash-Backs, Loyalty Rewards and related benefits. No previous version, alternative wording, draft, representation, statement, advertisement, publication, promotional material, marketing communication, social media post, document or other communication shall have any preference, priority, force or effect to the extent that it is inconsistent with, conflicts with, or differs from these terms and conditions, and none shall amend, vary, override or supersede these terms and conditions, or create any entitlement contrary to them, unless such amendment or variation is expressly incorporated into the terms and conditions published on car4less.co.za by Car4Less. Accordingly, these terms and conditions shall be regarded as the final, superseding and prevailing wording, and no other version shall take preference, precedence or priority over them.

9. Vehicle finance

Vehicle finance is provided by third-party registered credit providers (banks), not by Car4Less. Any finance agreement is concluded directly between you and the bank on the bank's standard terms, subject to the bank's credit and affordability assessment under the National Credit Act 34 of 2005. Car4Less is not a registered credit provider and does not guarantee finance approval, any particular interest rate, or any particular instalment. Calculator results on this website are planning estimates only and exclude bank initiation and service fees.

10. Delivery

Delivery timeframes depend on manufacturer stock and logistics and are estimates only. Risk in a vehicle passes on delivery in accordance with the sale documentation. Any deposit or trade-in arrangement will be recorded in writing before you are bound.

11. The Business Agency (franchise) opportunity

Information on this website about the Car4Less Business Agency — including capital packages and income tables — is a summary of the official Business Agency Proposal and is provided for information only. Income figures are illustrative scenarios, not a guarantee, forecast or promise of income.Actual results depend on the agency's activity and market conditions. No business agency relationship arises until a Business Agency Agreement is concluded and the applicable capital payment is made. Prospective owners should obtain independent legal and financial advice before committing.

12. Enquiries and submissions

Forms on this website hand off to WhatsApp or email; by submitting an enquiry you consent to Car4Less contacting you about it on the details you provide. You warrant that information you submit is accurate and that you are entitled to provide it. Communications transmitted over WhatsApp or email are subject to those platforms' own terms and security.

13. Intellectual property

The Car4Less name, logo, slogan, website content, page designs, diagrams and documents are the property of Car4Less or its licensors and are protected by law, including the government- gazetted provisional patent covering the Car4Less model. Vehicle manufacturer names, logos and model names are the trade marks of their respective owners and are used for identification only — their appearance does not imply endorsement of Car4Less. You may not reproduce, scrape, frame or commercially exploit content from this website without our prior written consent.

14. Website use and availability

You may use this website only for lawful purposes. You may not attempt to gain unauthorised access, interfere with its operation, introduce malicious code, or use automated tools to extract data at scale. We may suspend, change or withdraw any part of the website at any time without notice, and we do not warrant that the website will be uninterrupted or error-free.

15. Third-party content and links

The website links to third-party platforms and articles (for example WhatsApp, Medium, bank and manufacturer sites). We do not control and are not responsible for third-party content, terms or privacy practices. A link does not imply endorsement.

16. Disclaimers

The website and its content are provided “as is” for general information. Nothing on this website constitutes financial, legal, tax or insurance advice, or advice as contemplated in the Financial Advisory and Intermediary Services Act. Reviews, comparisons, guides and blog articles reflect editorial opinion and publicly reported information at the time of writing and may become outdated.

17. Limitation of liability

To the maximum extent permitted by law — and without limiting any right you may have under the Consumer Protection Act 68 of 2008 — Car4Less, its owners, employees and agents will not be liable for any indirect, incidental, special or consequential loss, loss of profit, loss of data or loss of opportunity arising from your use of this website or reliance on its content. Where liability cannot be excluded, it is limited to the maximum extent the law allows. Nothing in these terms excludes liability for gross negligence or wilful misconduct to the extent such exclusion would be unenforceable.

18. Indemnity

You indemnify Car4Less against claims, losses and costs arising from your breach of these terms, your unlawful use of the website, or inaccurate information you supply to us.

19. Privacy

Personal information is processed in accordance with our Privacy Policy, which forms part of these terms.

20. General

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction. If any provision is held unenforceable, the remainder continues in force. No failure to enforce a provision is a waiver of it. These terms, together with any written documents concluded with you, are the whole agreement regarding the website.
